The Owner’s Corporation

The Owners’ Corporation (OC) is an active group of genuinely interested individuals, comprising roughly one-third owner-occupiers and two-thirds rental-providing owners, and all of whom have demonstrated real concern that residents enjoy the benefits of living in the complex, and work collaboratively to enhance the experience for all other residents.

The OC takes pride in maintaining well-presented common areas, including in the car park, foyers, hallways and stairwells. The Committee, together with our Managing Agents (Ace Body Corporate Management-Elwood/St Kilda) and Building Facilities Management (Melbourne Building Management) are vigilant in regard to maintenance issues both major and minor, and are committed to proactive adherence to Government and Council building and WHS regulations, and to ensuring the provision of sound security measures for the safety of all residents.

Owner’s Corporation Rules
The management and conduct of your Owners Corporation is essentially governed by the Owners Corporations Act 2006 & the Owners Corporations Regulations 2018.

Ensuring that residents living within the apartment are familiar with the rules will eliminate Breach Notices for contravening the Rules of the Owners Corporation.

Building Rules & Guidelines

Fire Alarms

Each floor of the building has wired-in fire alarms in the common areas that are connected to a monitoring company. If the alarm goes off the Melbourne Fire Brigade is notified and will attend the property immediately. Otherwise, fire alarm testing will be carried out in the morning of the first Monday each month.

False Fire Alarms
One of the most common causes of false fire alarms in apartment buildings is related to cooking which generates smoke or steam that escapes the apartment when a resident opens their apartment door which in turn sets off the alarms in the common areas. When the MFB attends for a false fire alarm, they will notify Ace Body Corporate of a ‘Call Out Fee’ which will then be passed on to the resident who caused the alarm to activate unless a reasonable excuse can be given.
Smoke Detectors

Smoke detectors are installed in each apartment and in the common areas. It is a requirement that all smoke detectors are hardwired in with a battery back-up.

9-volt battery – if you have a smoke alarm with a 9-volt battery, replace the battery every year.

10-year battery – if you have a smoke alarm with a 10-year long-life battery, no replacement is needed

Rental providers must ensure that smoke alarms are installed correctly, operational and tested every 12 months.

Pets
Pets are allowed subject to approval of the lot owner.

Owners of pets are required to ensure that the pet does not disrupt the smooth running of the complex, either by regular barking, or by being unrestrained within the building. Accidents do occur; it is the responsibility of the pet owners to contact Ace Body Corporate immediately should a pet defecate, urinate or vomit within the common areas. The OC believes that it is only reasonable that the cost of the cleaning and disinfecting is to be borne by the pet owner.

Noise

Please be mindful that you are living in close proximity to your neighbours. For the enjoyment of everyone around you, any noise that you generate whether it be from any radio, television, sound system, musical instrument or any other noise should not be unreasonably excessive. In general, a noise should not be heard outside a neighbour’s apartment, Monday to Friday: before 7am or after 9pm and on weekends and public holidays: before 9am or after 11pm.

Steps to take for a noisy neighbour

If it is safe to do so, the best way to try and resolve the situation is to approach your neighbour and come up with a solution together as they may not be aware there is a problem.

Smoking/Vaping
Smoking and/or vaping is not permitted in any of the common areas within the building including passageways, foyers, stairwells, the lift and car park.
Parking/Storage

Each apartment has one or more designated car spaces, some of which include storage cages. Residents whose parking spaces are without a storage cage and would like to install one should request a list of approved storage options from the OC Committee. It should be noted that Body Corporate rules state that each car must be parked completely within the boundaries of its assigned space.

PLEASE DO NOT PARK IN A SPACE THAT IS NOT ALLOTTED TO YOU.

Visitor Parking

Ormond Road
Visitor parking is available at the ground floor level behind the retail shops from Ormond Road. There are 6 car spaces and 1 x Motorcycle space (fits up to 4 motorbikes) with a 3-hour limit.

Spray Street
Visitor parking is available on the basement level. There are 3 car spaces and 1 x Motorcycle space (fits up to 3 motorbikes) with a 3-hour limit.

Rubbish & Recycling

Bin Storage & Collection

Bins are housed in the refuse rooms which are located:

  • In Ormond Road, beside the ground level car park, behind retail stores.
  • In Spray Street, in the basement level car park, adjacent to the entry to the main stairwell. 

All Bins are taken out and returned by the cleaning contractor and are cleared by the City of Port Phillip each Wednesday morning.

Recycling

Residents are asked to place separated rubbish and recyclable items in the correct bins –

GREEN LIDS – General Waste should be bagged and tied. 

YELLOW LIDS – Recycling items include cardboard, glass & plastic bottles, cartons, polystyrene (foam), newspapers. Cardboard boxes are to be broken up so that maximum capacity is achieved. Plastic bags are not recyclable. 

Hard Rubbish

Please note that NO HARD rubbish is to be left onsite. Any person found to be dumping hard rubbish will be asked to remove it or charged for its removal.

Paying Levies - Lot Owners
Each individual Lot carries a specific ‘Entitlement and Liability’ notation.

Lot Entitlement is the proportionate share of ownership of the Owners Corporation assets, including common property and also determines voting rights at a meeting of the Owners Corporation.

Lot Liability is the proportion of Owners Corporation expenses, which the Lot owner (as the member) is legally liable to pay.

Members are invoiced for their share of the annual budget estimate as discussed at the Annual General Meeting. These are forwarded directly to the owner of the relevant lot and are due:

  • 1st March,
  • 1st June,
  • 1st September and
  • 1st December.
Arrears - Lot Owners

Contributions overdue by 14 days will be charged interest at 10%. Lots owners will also be charged for all external legal and associate costs incurred by the Owners
Corporation in relation to the collection of arrears.

The Owners Committee will consider requests for ‘Special Needs Payment Plans” on application and on a case-by-case basis. Payment Plans include a condition that failure to adhere to an agreed plan can lead to the debt being placed in the hands of lawyers for recovery with all costs passed on to the debtor.

Insurance

The Owners Corporation has an insurance policy which covers Owners Corporation property but regardless of how the damage occurred, does not extend to cover any damage to privately owned fittings including curtains, blinds, light fittings, electrical fittings, carpets and appliances which are not built into the apartment and can be removed.

Residents should arrange a Contents Insurance Policy to include the above items. Non-Residents should arrange a Landlords Insurance to protect their investment

If any resident is responsible for damage to the common property, they may be responsible for the cost of reinstatement.

Visitor Guidelines

Visitors will need to enter the apartment number into the intercom located on the wall to the right of the front door, followed by the ‘Bell’ symbol which will then contact the relevant apartment.
